Insurance Coverage Question Issues-Is there Insurance Available?

There are other insurance issues as well, such a coverage questions-essentially, the insurer believes there is a question of whether you are covered under the policy, and they issue something known as a "Reservation of Rights". It is a document that allows them to investigate coverage without committing themselves to covering you! Then they will call you up and ask you a lot of questions on a recorded statement, sort of like a deposition or being in court. It isn't too much fun, since later the adjuster will take your answers and determine if the insurer should give you coverage. Make a misstatement on some minor detail, and you could be precluded from having your claim processed at all. Once the insurer has made their decision, it is extremely difficult to get them to change their minds.

That is why it is important to have an attorney to prepare you for what might happen. Of course, you need to cooperate in order to get coverage, but you should also be prepared for the types of questions asked and how they will be asked. The most honest person in the world can make a mistake if they aren't ready for a statement, and unfortunately, going back and changing your story, even if due to an innocent error, can look as though you are, well, "changing your story".
